James Polk is referred to as the "eldest son" by wife Lucy,  in an 1806 Darlington Co. deed.

Thomas Polk made his will in 1800 leaving all his land, and personal effects to two of his sons by his previous marriage, Thomas, Jr & Isaac who at the time lived with him.   This may have been done when he married his second wife Lucy, or just prior to their marriage.

Thomas Polk's Will was proved in 1806, and Lucy was still living in the 1840 census, showing her to be 70-80 yrs of age, but this I believe is an error in the census as all other census records indicate she was born about 1772-74.

Thomas Polk was born prior to 1755, & his #1 wife also born Prior to 1755.

Thomas Polk, (Sr) made his will in 1800 , naming sons Isaac, & Thomas, Jr, (III) "now living with me"  and leaves all his land , goods, and effects ,"which I am now possessed with",  refers to itemized list, including 100 AC land on Sparrow Swamp. (1784 Grant)
In the 1800 census he and his wife were over age 45 yrs,  (which would make both born PRIOR to 1755)   He died pr to 1806, but in the meantime, he had married a second, and much younger wife, Lucy, by whom he had  2 or 3 children, including James, and at least one other son.

"Know all men by these presents, that I Thomas Polk (Jr.) of said County and District, in consideration of the sum of seventy-five dollars to me in hand paid by Lucy Polk of the same place, widow of my father Thomas Polk, deceased, in behalf of her eldest son by my father , Viz: James Polk, infant,* etc Also mentioned are Isaac Polk, a brother to Thomas Polk,( Jr.)  This was a fifty (50) acre parcel of land located on the S/S of Sparrow Swamp, which is located near the present day city of Florence, SC.  Sparrow Swamp is shown on a 1773 map as being bet. Lynche's Crk, and Pee Dee Riv.

*James Polk was born about (July) of 1803, so he would be referred to as an "Infant" in  March, 1806-sgs

PETITION OF CITIZENS OF DARLINGTON TO REPLACE COURT HOUSE DESTROYED BY FIRE

To the honorable the President Speaker and honorable the Members of the house of the Senate of the State of South Carolina, (Gentlemen) We your Petitioners citizens of the district of Darlington beg leave to represent to your Honourable body that the court House of said district has been destroyed by fire together with the records of the Court-- The difficulty that we now labour under for the want of a Court House, must be obvious to your Honorable body. We therefore your petitioners Pray you will take into consideration the situation of the district, and appropriate a sum of Money for the Purpose of erection a new building under such Regulations as you in your wisdom may think best, And your petitioners as in duty bound will ever Pray, &c, &c.
